After driving a stolen car through a building and causing serious injury?

I can just see the cop saying, "well, I know he's been drinking but we don't want to breath test him".

If they wouldn't test this guy, who do they test?

Well said mike. Although I'm still not sure I believe this story in its entirety. Who leaves the keys to their viper in the car even if it is stored with a friend.

Exactly, I think that may be the key point of how this pans out.
I hope the child recovers.

The keys were in the car. i was always told if someone steals my car, ( Northerner we leave cars run to warm up)
and someone steals it ...no coverage because the keys were in it.
Sort of the same thing, keys were in it.

I have been watching this thread with interest. Just as an FYI, a friend of mine stored one of his Vipers at my house for almost a year, keys included. Indeed, he told me to "take it out and circulate the fluids" every once in a while, which I did every couple months. No accidents (of course) and if I was going anywhere further than a few blocks, I would call him to let him know. Mind you, I had my own GTS sitting next to it so there was no great need for me to go out and play with his RT/10 (unless the hardtop was off ;) ).

I think he will be hard-pressed to prove theft when the car was at the other guy's house with the keys in it. While I know this isn't exactly true, "possession is 9/10's of the law" and his friend was given possession of the car, just not permission to drive it. It will be his word against his friends, and who had the keys? I hope this unfolds to everyone's satisfaction.

Viper crashes on a joy ride and a kid injured? Rarer news. One would think there would be a newspaper article he could submit as evidence.

First point.... the vehicle was voluntarily at the friends house... with keys. Especially if the friend knew the keys were there... you could have "permissive use" to deal with.

Your liability insurance will be primary if you "theft" angle does not work..... in any case a good lawyer will sue you anyway! I hope you have a personal umbrella liability policy... because you could be sued by your friend for his childs injuries? It could happen?

If you had to store your Viper somewhere why didn't you just rent a storage unit and put it there for the winter? His attorney's first arguement should be... "didn't you expect he would drive the car at some time? you did leave him the car and the keys in the glove box?....... Would you have expected him to move the car if it was in danger of being damaged?"

12 years in the insurance industry (10 in claims) I have become a little jaded.... but seems to me you are in a tight spot... no collision coverage.. and an "iffy" play at theft.

By the way... it is still just a car... for crying out loud the guy's son is in danger of losing eyesight..... yeah I'd be pissed..... but you should've kept collision coverage on a $40K+ car even if it was in storage!

Hope the boy keeps his eyesight

If this is a real case, and at this point I just can't tell, it look's like malcoll, above, is right on the point. You don't have any written contract with the gent who owns the garage. He could say anything. He could say he was storing the car in exchange for the use of the car. He could say you insisted that he drive the car every few weeks. He could say the loss of control was due to a problem with the car and you are responsible for paying. The fact that he was your buddy would make some kind of storage for use deal very believable.

If this is for real, you could be in much more trouble than the loss of your car.

As I've said before this story seems fishy! This guy was suppose to post a day or so ago with pics of the car. I think it was a bogus post.

The car being damaged is one thing to BS about but adding in injuries to a child is not in the least bit amuzing, especially if you have children.

Ok now I have lost all faith in this guy. I believed him at first and even gave him he benefit of the doubt. I do not understand how someone could like about someone getting hurt like this. :confused: All I can say is what he did is pretty disappointing. :(

I think that there is an apology in order and let me be the first to say I am sorry. I was believing him until the very end and now he just proved me wrong. Again I am very sorry for not believing you and I should have stuck with what I believe in.
