Covertible Top Latch Issue

Is the convertible top latch suppose to remain in the unlatched position after removing convertible top? Mine
I believe used too and now it wont stay locked in the unlatched position. My dealer says its suppose to be like this. Either im nuts or he is? Help

my 05 front latch used to stay down after opened now i have to pull front latch back then hold the hook down then close the latch , any idea how i can fix this, there must be a spring thats off or something too keep hook down when opened ?? any help
