My lawyer and prosecutor worked a deal:Supervision 1yr.,4hrs.traffic school,$200 fine(bail posted). We waited to be the last call.Prosecutor advises, judge looks up at me and says"DDDodge",I wanted to say "VVViper",but respecfully laughed along, thinking this guy doesn't get it,and missed my plate"
TOOOFST".Then says to prosecutor "isn't that a bit light for 94mph,maybe some community service."(I'm now Fred Flinstone)The prosecutor says ,we don't any conflict with the officer.Judge says ,who would at 94,OK,bye!Now the lucky part,Traffic school is now offered on the net,you can take 1hr.sections and have about a week to finish, anytime of day!I guess its all a win,Question,How do you drive a viper for a year without a ticket?

The advice to "kick it upstairs" must be a Texas specific procedure. There is no such thing in Illinois. And it seems unusual that the prosecutor is afraid/unwilling to deal with the paperwork or the expense involved in a trial (jury or otherwise). It really isn't all that much.

Prosecutors get paid the same regardless and it doesn't cost 'em anything but their time to try the case (and they'd be doing other work anyway). Maybe it costs the county for the jurors and whatnot, but it sure doesn't cost the prosecutor anything.

Additionally, the prosecutors in traffic court are typically brand new lawyers who would love to try a jury case. Traffic court is probably their first job and they rarely, if ever, get a jury trial there. So they may well jump at the chance, rather than try to avoid it.

Texas could be different from the courts where I practice here in Illinois, but there aren't any courthouses where I appear that demanding a jury will elicit anything from the prosecutor but a "well, OK, whatever."

In Illinois, the right thing to do is exactly what TOOFST did. He hired a lawyer who then worked things out with the prosecutor. It sounds like the judge almost wouldn't go along with the deal, so TOOFST got very lucky, indeed. I've seen a number of judges really hammer guys with big speeding tickets, despite the prosecutor telling the judge that the agreement between the prosecutor and the offender was for something along the lines of the TOOFST deal.

PS. No flame intended, but using paragraphs from time to time in a post makes it much easier for the reader.

kids, traffic, etc. must be a factor when considering the lower speed limit.

Speed limits are set to the lowest common denominator, that is the worst driver and we are all forced to play by the same rules.

And don't forget the biggest factor - make the speed limit so ridiculously low that it will be easy to find speeders and extort more money from them.
