Worst day of my life I lost my snake!

Today is Tuesday March 4th. I was akoen this morning by the ringing of my phone and the gentlemen where I store my viper at 8:00am. He proceded to tell me that he really wanted to call me as soon as this (you'll find out) happened to me but was first concerned with his son's health. At this time the best had got of me and what the hell he was talking about. He proceded to tell me that he took my car for a spin up the block SATURDAY NIGHT ( I FOUND THIS OUT TODAY TUESDAY 4 DAYS LATER). He proceeded to tell me that he was comming home and goosed the car and lost control of the car and went through a telephone pole a sporting goods company's sign, and totaled my 1997 GTS BLUE AND WHITE! So at this time his son (12y/o)is in the hospitals ICU and my lose his right eye. He aksed me not to go see him b/c his son was shoken up about the whole situation. But I still went to go see him. So here is the kicker. I now have had to file grand theft auto charges on him. The city is charging him with Vehcile assault on a minor, the store owner is suing him for destroying his sign and the loss of bussiness on Sunday and Monday when he had no power. I have spoke to his insurance company, hired an attorney, and have talked to my agent. I have only had the car on Fire and theft due to it being winter here in Ohio and not being able to drive the car. Now that his insurance company is investigating this they are not sure if they can pay for the claim sine it was UNAUTHORIZED USE OF A VEHICLE! So I am seeking all viper owners / lawyers who would like a good case. I am also seeking anyone who is willing to sell their 97 Blue and white viper with less than 18k miles on it. Sounds like you just need to give this guy a loaded gun, let him do what he needs to do, and then sue his estate! What a ********! I feel for you man! Hopefully you'll get everything taken care of. Did you know him? Was he a friend? WOW!

I'm not a lawyer, but it would seem to me that you MUST report your car as stolen (and it was). This will insulate you from possible liability issues with any of the people or property that he harmed during his UNAUTHORIZED joy ride. You should then be able to collect from your own company under theft. I don't understand why you didn't immediately think that your vehicle was stolen. IT WAS, unless you told this guy that he could take your car out when he wanted to.

I really feel bad for the 12 year old kid that might lose his eye - that's horrible. I would agree with the above post, you first need to establish your position and report the car as stolen - which it sounds like it was. If you don't report the car stolen (GTA) you might be liable for more than you bargained for.

The car has been reported stolen and the dirver was a now former friend of mine who was stroing the car for me for the winter, since I have no garage at my current residence. He is suppose to be turning himself in tommorow to the Tallmade, Ohio police department. I have pressed charges of Grand theft auto. he has many lawsuits comming at him and I hope he frys! I hope his insurance company takes care of it bc I sure as hell know that I do not! I appreciate all the thoughts guys PLEASE KEEP THEM COMMING! GET MY BRAIN STIRING AND GIVE ME SOME GOOD IDEAS!!

Sounds like the guy who is responsible is getting what he deserves. Lets all pray for the innocent victim of his negligence.

What, you didn't like my idea? JK I know you don't want to hear it, but it sounds more like joy riding than grand theft auto. That's a much lesser charge. It doesn't sound like he was actually stealing it, he just exercised EXTREMELY poor judgement. I don't think you will be held liable for anything though because he drove it without your permission.

I have one question where did he get the keys from?Did your friend have a set in the house?And was he home alone at 12yrs old? I would be going off the wall right now. I feel bad that the kid got hurt but he should have never had the chance to get the car out if it was my kid. I hope everything works out for you.

Stories like this make me feel like my ol’ man must’ve been the smartest man alive. He would have NEVER done something that stupid. That kid has got one idiot for a father. Throw the book at him you have to too cover your A.

I normally left the set in th glove box bc I would always seem to forget the keys and it is a half hour roundtrip to go back home and to the car. His son was at home with him, so was his parents too. They( parents) were getting ready to take his son and daughter back to Vermont. he is divorced, just bought a house, and knee deep in my horse [******]! TOO TOP IT ALL OFF THE KID WAS THROWN FROM A PICKUP WHILE FOUR WHEELING WITH HIS STEP-FATHER A FEW MONTHS BACK AND HAD HIS ARM TORE TO [******] AS HE GOT RUN OVER. I knida felt bad about throwing the book at him but all in all I hope he will leanr his lesson!

Hope he is a "good" friend. All he has to say is that you said it was OK, every once in awhile, to drive it....don't worry it's insured (your thanks for storing it). Try that before a jury. Not playing the "devils advocate", but people (friends) do "strange" things under legal and financial pressures (especially with his son's injuries). Make sure all your "ducks" are in a row. Best of Luck in the resolution of this matter.

As a fellow Ohioan, I'm very sorry to hear of what happened.

What a hastle to go through for you. I definitely feel sorry for the child. To give the dad a slight benefit of the doubt, his son's dream car might've been the viper and possibly the dad felt bad because he couldn't provide his son with one even though his son kept seeing it. Does that make what the father did right? HELLLLSSS NO. The poor son might have to pay for this the rest of his life... scars, possible loss of an eye... I hope he finds a great lady in the future. Maybe Chuck can hook him up!

As for grand theft auto... good luck. It doesn't appear like there was criminal intent to do that and that's what courts look for.

Sorry Bill. If this happened to me, I'd be totally and thoroughly crushed. I'm here for support if you need me.

Don't let the insurance company tell you that "joy-riding" isn't theft!

Criminally, I think the DA needs to show he had no intent to return the car to you, so I don't see the DA following through on that - the DA will most likely have NO PROBLEM with joy-riding - which is still "theft", just not Grand Theft.

That being said - "I'm no lawyer", but you may need one to "persuade" the insurance company to "remember" that theft = taking it without your permission - joy-riding.

Best of luck on a quick resolution (at least BEFORE the weather gets better).

Maybe the DA can argue it doesn't matter what his "intent" was because the stupid SOB DIDN'T return it. The *sshole balled it up and left it in a store window.

I frankly couldn't care less if this Darwinian award nominee lost everything he had and then got to sit in jail to think about it for the rest of his pathetic life.

Uh ... 1st of all. Get rid of that signature. Think about what someone will think about your credibility, if they read this. Secondly, get a [******] good attorney, not the kind that drives a Corvette or a Viper, like you might find here - no offense guys, but we're talking Johnny Cockring here .... and finally .... keep your fingers crossed, and just go for an 03 new platform, clown shoe.

Worst case senerio your insurance will have to eat this one since the car had theft on it. How about some details about your ex friend? Is he well off? If not I dont see how suing him is gona do any good?? I really feel bad for the kid :( I hope he doesnt lose his eye :mad:

well guys I appreciate all of your help so far. My girlfriedn is getting made becuase I keep checking this forum like every 10 minutes to see what is new. I am still planning on throwing the bokk at his with the power of a cannon. I do hope he sits in jail. That means he is back payment on his house, credit cards, payments, and most of all family life! the info about glovebox worries me.
if he gets a spinmaster YOU may be the one in trouble.....
as mentioned above hire the best lawyer in Ohio and pray!!

I pray for his innocent little victim.... poor kid. :(
the car can be replaced his vision can not.... :mad:
