And the saga continues....all the excitement was fun, but I have come to find out this still is not over.
Chrysler has filed a motion for reconsideration on the granted motion to dismiss and we are now in the process of scheduling yet another hearing.
Hopefully I will have definitive good...
Once this became a mess, the dealer did finally offer to represent me in this however my attorney and I agreed that having them do so would not be the best approach.
Now that is some funny stuff! But seriously all...I could not have found a better friend/attorney to handle this for me so yes, "mad props" to him...and his wonderful assistant.
Today is a good day....thanks everyone for the well wishes!

Docket Text: MOTION TO DISMISS IS GRANTED. D CROW
Jon:
Today was just about me and Chysler Financial Corp. (CFC). I am part of CFC's amended complaint against three other people.
The Mercedes attorney was simply there to observe. He sat in the bleachers so to speak. They just want to see how this is going to play out and they are not...
Ok...so my 15 minute hearing has come and gone.
End result: nothing really
Quick summary:
- we presented
- Chrysler presented
- Judge reprimanded Chrysler for bringing new cases to support their claim that they never provided to us. Judge asked if they were trying to "ambush" me...
Well it's been a while....we finally received a letter from Chrysler's attorney, signed, that they will not attempt to repo my car "without a duly noticed hearing and court order approving same".
We have court in the morning on our Motion to Dismiss so everyone please feel free to say a...
I bought my black side emblems from Viper Parts of America. $135 per side before the member discount.

I'm not concerned about any story following the car. This isn't a situation where I bought what appeared to be a clean car and then come to find out someone hid the fact that it was salvaged/wrecked and now no one will want to buy it.
This is a question of ownership. The state says I own...
In response to your first question, no. We are waiting to see how the motion to dismiss plays out.
As far as someone trying to locate the car....I have no idea. We haven't seen anyone at my home or office. Chrysler has known where the car has been the last two years based on the court...
Thanks very much, however I feel like we are at the same place as when I started.
The only difference in my life now is that some documents have been filed on my behalf and I am driving a black on black C300 with a big Delray Mercedes Benz sticker on it instead of the attached.
If you are referring to my reference as to where my mods were done, I greatly appreciate the concern, but the car was picked up from there two days ago and now she is resting comfortably in a very secure location.
Update:
My attorney is filiing a Motion to Dismiss today after many discussions with MB's attorney.
As a reminder for those joining late, Chrysler has two claims against me:
1) They seek a declaratory judgment as to the extent of CFC's security interest.
2) They seek replevin of...
Update:
The GM at MB Delray called me yesterday to let me know their attorney is in contact with Chrysler's attorney. They want to gather more details on the lawsuit and, per the GM, see how strong a case Chrysler has against the other parties.
He stated I should have word from him today...
Yes, today I filed a complaint with the AG's office but they gave the impression that they dont look into these matters until they have a number of complaints filed so not a whole lot of confidence here.
I also contacted the Florida Dept of Highway Safety at the AG's suggestion and they sent...
Multiple attorneys advised me not to drive the car....or at the very least not to leave it anywhere unattended since there is no guarantee on attempts to repo the car.
You are not missing anything and I provided all the details. I don't want to be involved in a lawsuit that goes on for years and pay insurance on a car that I cannot drive. Let's say this goes on for a year and then a court determines that there was fraud with the towing company, that CFC's...
UPDATE:
My attorney did some research and found this case has been going on since July of 2009. The orginal complaint was amended and I was served after CFC learned that I now had possession of the car.
The second owner of the car was served in July 2009 so he new full well when he...
We are on the same page. Neither the General Counsel at my firm, nor my attorney can figure out why Mercedes of Delray was not listed as a defendant since they sold the car. Their assumption is that it is a matter of politics.
My attorney is preparing my Answer now. Updates to follow...
I had the car inspected, I obtained the carfax on my own and was given a title. The state was not aware of any of these issues otherwise they would have stopped the title from being issued. Not sure what more I could have done. I bought the car from a respected MB dealer.
This is the most condensed version of the last three days that I can come up with:
I wake up Saturday morning, after owning my car for two months, to a process server at my door. He hands me a summons which lists Chrysler Financial Corp. as the Plaintiff and the Defendants as the first two...
I think it looks great the way it is having seen a few non-black vipers with black/carbon hoods.
Maybe someone should photoshop your pickup with powdercoated wheels and a yellow grill. That's where I would spend and have the ultimate twin package in the driveway.
