What makes the difference between smog legal and non-smog legal superchargers?

I think the main difference is the investment required by the manufacturer to gain certification with the California Air Resources Board.
Most kits will pass smog tests cause the Viper burns clean, but in California the visual inspections need to be backed by an "EO" document for the modifications or you won't pass.
