I know you guys will know this.

Remember, I live in Georgia.

From a red light, what is a legal vs illegal take off. I thought that if you simply accelerate hard, you were o.k. as long as you keep the tires quiet. I was also under the impression that if you keep the acceleration under 60 mph(or whatever the posted speed limit is) you were fine.

I spoke with a local police officer at length. He said that if you are using "excessive power" that you could be ticketed. That sounds very subjective.

Any legal experts here????

Well the Supreme Court in Washington DC might support your claim...

Otherwise it'd be you against a mostly unsympathetic local legal system

i know here in CT the law is exactly like you said, you can go from 0 - speed limit as fast as you want as long as you don't squeel the tires, if you do they give you a ticket for an "unsafe start" i got on in my mustang a few months back.

There is the catchall violation :

- Driving in an unsafe manner (minor/civil)
- Reckless endangerment (major/civil/criminal)

Bottomline, look out for yourselves. Don't count on the cop's good nature to save you.

The officer is the man on the street. He CAN ticket you if HE feels you have broken the law as HE interprets it. Now if it holds up in front of "your honor" is a different story. Bad part is you will have to pay court costs, your time to sit for several hours in court and possibly a lawyer.

In GA, I think there is an "exhibition of speed" violation also... purely subjective, of course... doesn't help us viper owners...

In Kalifornica, it seems that every putz that gets jealous assumes you are a criminal, because your car is faster than theirs. Too many goody-two-shoes, dudley-do-right, self-righteous a-holes in the world. But if they win the "race", they think thats ok.

Only problem with that is usually the judges side with the cops and/or if the cop is on court patrol they more then likely have lunch together so who's side is he gonna take?

anything over 0.0 sec. is legal. If you accelerate any faster your tires will fold under the car and you'll end up in 1955. :D

Here is my first hand experience...
made a left from the light (designed left lane had the arrow) and i went for it. no smoke no tire squeel just taking off at a good clip.
zoom right up to posted 45 mph speed.
i look in the rearview the lights are going on back in the intersection and i start to pull over right away.
i am stopped by the time the officer gets to me.

he asked license and registration.
looks at and says.. "James keep pulling away from the light like that and it is going to be a long summer, go easy."
and hand back my stuff.
he was in an unmarked cop car... don't even think those guys own a ticket book.
i think he just wanted to see the car.
but i was under or at the legal limit and got pulled over..
it is all up to the cop..

Nice thing about Vipers is that they take off so smoothly they don't seem to be taking off in an uncontrolled manner.

Another argument is that the car looks so fast just sitting still how can you possibly make a judgement about how fast the car took off.

Personally I think half the fun of the Viper is that you can take off so quickly you don't even have to break the speed limit to have fun.

It is sad to say but it is not a legal matter.
It depends on the way you look when the cop stops you and on the size of your bank account. If you can pay a good lawyer than you are not a criminal otherwize you are ! It is true espectially in the South.


Those who are from Texas ...
Do you remember that mother in 2000 who was arrested because she didn't wear her seat belt ? She went to court and lost !! Now she has a criminal record !

I think every thing depends on the cop who stops you. There are stupid cops and there are great cops. It's like in any other domaine.

Photo Pro, logical but may not be considered legal depending on the circumstances. Once I was logical and was ticketed for exhibition of speed many years ago in IL.

In DE Exhibtion of Speed is so subjective here that if you are at a light and a ricer takes off in the next lane YOU can also be fined, even if you didn't do anything. Very, very tough to fight in court especially if the judge knows you from past indiscretions.

There was some debate in Detroit just a few years ago whether one should even stop for an unmarked police car.

Criminals had been sticking flashing lights on their dash and 'pulling people over'.

The Michigan State Police even suggested not pulling over but rather driving to a police station. The Detroit police as I recall said they normally call for a marked car for traffic stops.

I'm not sure where that debate is at presently..

I can't imagine anyone NOT being able to get out of an exhibition of speed ticket. When the oinkers hand you the ticket they'll say something like "I could have ticketed you for such-n-such but instead I'm just giving you an exhibition of speed ticket."

Then you drive away thinking "Thank Gawd."

Not me. "See you in court ****."

I have been pulled over for "Excessive show of speed" as the ticket said. However the officer was so consumed with my car that he gave me a warning!
I live in SC.

FE065 - I asked that question to a cop once. I was pretty disturbed to see as many unmarked patrol cars on I-43 with nothing but a small dashboard lights front and rear - the thing that got me was the fact that they had civilian plates.

Basically, If your in question, pick up your cell phone and call 911. Keep an eye on the mile markers, let them know the situation and where you are. They'll either check with the officer, or send a marked car out to you.

I have gotten several exhibition at speed tickets in the past and usually you need to squeal the tires to warrant that ticket. And swerving between lanes can add on unsafe lane change, and reckless driving to the charges. But as it has been mentioned, the policeman will decide if he thinks that you need a lesson or not.

I've been pulled over 3 times so far in the Viper, mostly because the car stands out, but also because you can easily exceed the speed limit whithout trying. But after getting lectured on driving safety, I've been let go all three times with just the warning.

It really depends on the cop. And then the judge, if you do get ticketed.
Speeding is an infraction (at least up to 30MPH over the posted limit), but reckless driving and exhibition of speed are misdomenors, and you can be potentially jailed. :eek:
