WASHINGTON (AP) -- General Motors said Thursday it will reconsider its decision to close some dealerships as part of a compromise to stave off federal legislation that would require it to keep dealerships open.
GM will conduct face-to-face reviews with dealerships and offer binding arbitration with those who face closure of their showrooms. The largest U.S. automaker also said it would be more transparent about how it picked the dealers that will close. It will also speed up payments to assist those targeted for shutdown.


As part of its deep restructuring this year, GM has said it will cut 2,400 dealers from its 6,000-dealer network by next fall. Chrysler announced similar plans, slashing 789 dealers as part of its bankruptcy proceedings this summer. Both automakers say the cuts are needed to better align their dealer network with much lower demand for cars and trucks.

But dealers accused the automakers of closing lots that were still profitable, and said the auto companies weren't forthcoming about the criteria they used to decide who will close and who stay open.

The House passed legislation in July that would force the companies to reverse their closure plans, though the Senate has not taken it up. The Obama administration opposes the measure.

Talks brokered by Congress between the dealer groups and the automakers began in September, but had stalled over disagreements over factors like the review process for dealers slated to close.

Lawmakers have warned that if an agreement isn't reached, legislation would move forward to deal with the closures. Most of the Senate Commerce Committee wrote a letter two weeks ago to Chrysler and GM seeking more information about the talks and warning that dealers should be treated fairly....

TODAY ! Chrysler has apparently announced today that they are re-examining the appealed closures! http://www.nytimes.com/2009/12/04/business/04dealer.html

"Chrysler forced 789 dealerships, about a fourth of its network, to close in June. G.M. refused to renew franchise agreements with about 1,100 dealerships, though they are not required to close until October 2010 and many have not publicly identified themselves.
G.M. and Chrysler each said they would provide the dealers with the specific criteria used to make decisions about cutbacks and listen to individual rebuttals. Dealers that are not reinstated can take their case to binding arbitration.
Chrysler dealers who win a reversal would be allowed to either open a store in their previous market or be given a list of available markets to choose from.
The review process would begin Thursday at Chrysler and in January at G.M."

its not gonna happen. they will just put such high standards up for those lost dealers that there is no way they can afford to meet them. chrysler stinks !

Yes, but an arbitrater may be pretty sympathetic to the countrys oldest Dodge dealer (who has always been small)...especially with5000 members and Dodge owners of the VCA writing in support.

Chrysler Group LLC today issued the following statement regarding an agreement to offer a binding independent review process for discontinued dealers:
Chrysler Group LLC appreciates the leadership that Senate Majority Whip Richard Durbin, House Majority Leader Steny Hoyer and their staffs have displayed in the effort to settle issues regarding discontinued dealers amicably.
As a result of these discussions, the Chrysler Group has agreed to provide a binding independent review process for discontinued dealers, with the understanding that this binding independent review is an alternative to federal legislation affecting Chrysler’s dealer network. As a show of good faith, Chrysler is implementing the binding independent review process today. The appeal process provides:
• Transparency on Chrysler’s initial dealer determinations through face-to-face meetings with Chrysler executives
• A binding review of those determinations by an independent 3-person panel
• An opportunity to join the new dealer network if that independent review panel rules in the discontinued dealer’s favor
The fundamental elements of the appeal process include the following:
• Provide each discontinued dealer the general criteria and standards used by the former Chrysler LLC in making its rejection decisions and the specific criteria considered and applied to the individual discontinued dealer’s circumstances
• Offer of a meeting with the discontinued dealer’s former Business Center to discuss the criteria, and ability for the dealer to present information to refute the rejection decision
• Right to call for a binding independent review if dealer believes its rejection was not warranted. Chrysler will abide by the decision of the independent review panel
• Two opportunities to join the new dealer network if the panel rules in the discontinued dealer’s favor: first, to join the new network as a Genesis (Chrysler, Jeep® and Dodge) dealer in the previous market area or, if that is not possible, to be offered an opportunity to open a Genesis dealership in another market area from a list of available market areas
• A detailed letter describing the offer will be mailed to all 789 discontinued dealers on or before December 10, 2009, and the process will begin at that time. This offer will be available in all states where Chrysler is legally permitted to offer these opportunities to join the dealer network.
Additional Chrysler efforts to provide a soft landing for discontinued dealers include:
• Chrysler has successfully found buyers for 100 percent of the discontinued dealers’ outstanding eligible new vehicle inventory
• On November 9, 2009, Chrysler notified the 789 rejected dealers, per our commitment in June, that if they desire, the company would repurchase eligible parts inventory at $0.68 on the dollar, which was the average transaction price for eligible parts sold among dealers between June 9 and September 10, 2009. Dealers received the information in both email and letter form
The road to recovery for Chrysler required the company to make some very difficult decisions and sacrifices in order to build a vibrant new company. While Chrysler has not closed the door to further discussion with the dealer groups, Chrysler believes that the process it offers today fully addresses concerns that Congress and the discontinued dealers have raised: it provides transparency, a right of appeal, and opportunities to join the new dealer network. Moving forward with this process today enables us to focus our efforts on the business of servicing our current dealer network and building and selling new Chrysler, Jeep, Dodge and Ram vehicles – our best way to repay the nation’s support.
